1. Acceptance of Terms

Welcome to Sanctuary, a chat application featuring conversations with philosophical characters. By downloading, installing, accessing, or using our App, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Earth ("we", "us", or "our").

2. Description of Service

Sanctuary provides users with the ability to engage in conversations with AI-powered philosophical characters. The conversational responses are generated using OpenAI's GPT API technology. Key features include:

• Chat conversations with various philosophical characters
• AI-generated responses based on philosophical perspectives
• User account management
• Payment processing for premium features or services via Google Play and the Apple App Store, managed through RevenueCat
• Educational and entertainment content

3. Eligibility and Age Requirements

3.1 General Use

Sanctuary is available to users of all ages. By using our App, you represent that:

• You have the legal capacity to enter into these Terms
• If you are under 18 years of age, you have obtained permission from your parent or legal guardian to use the App

3.2 Parental Consent

If you are under 18 years of age, your parent or legal guardian must review and agree to these Terms on your behalf. Parents and guardians are responsible for monitoring and supervising their children's use of the App.

4. User Accounts

4.1 Account Creation

To access certain features of the App, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4.2 Guest Access

You may choose to use the App as a guest without creating an account ("Guest Mode"). Guest access is subject to the following limitations:

• Limited to 1 free query/conversation
• Chat history is not saved or synchronized across devices
• Cannot access premium features or account-specific benefits
• Guest data is stored locally on your device and may be lost if the app is uninstalled
• No ability to restore conversations or preferences

To continue using the App beyond the guest limitations, you must create an account. Guest users can convert to full accounts at any time by signing up through the App.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any other reason at our sole discretion

5. User Conduct and Prohibited Activities

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable local, national, or international law
• Harass, abuse, threaten, or intimidate other users
• Impersonate any person or entity
• Attempt to gain unauthorized access to the App or related systems
• Use the App to distribute malware or harmful code
• Reverse engineer or attempt to extract the source code

6. Intellectual Property Rights

6.1 Our Rights

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, software, code, algorithms, character designs and philosophical content, and trademarks are owned by Earth or our licensors and are protected by Indian and international copyright, trademark, patent, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device for personal, non-commercial purposes in accordance with these Terms.

6.3 User Content

You retain ownership of the messages and content you submit through the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your messages to provide the conversational AI service.

7. OpenAI API Integration

7.1 Third-Party Service

Sanctuary uses OpenAI's GPT API to generate conversational responses. By using our App, you acknowledge and agree that:

• Your messages will be transmitted to OpenAI for processing
• OpenAI's terms of service and usage policies apply to the processing of your messages
• We are not responsible for OpenAI's data processing practices beyond what is stated in our Privacy Policy
• OpenAI does not use API data to train their models, as per their API data usage policies

7.2 Service Availability

The conversational AI features depend on OpenAI's API availability. We do not guarantee uninterrupted access to these features and are not liable for any service disruptions caused by OpenAI or other third-party services.

8. Payments and Subscriptions

Certain features or services within the App may require payment. All prices are displayed in the applicable currency and are subject to change with notice. In-app subscription payments are processed by the Google Play Store (Android) and the Apple App Store (iOS) and are managed through RevenueCat. By making a purchase, you agree to the applicable store's terms of service and billing policies.

If you purchase a subscription:

• Your subscription will automatically renew unless cancelled before the renewal date (managed by the store)
• You will be charged by the store at the then-current subscription rate
• You can cancel your subscription through your device's subscription management (Google Play or Apple App Store) or via the links provided in the app (RevenueCat)

Restore Purchases: You can restore previously purchased subscriptions on the Premium page using the "Restore Purchases" button. This is useful when switching devices or reinstalling the App.

Purchase History: Your purchase history is tracked and displayed in the app for your reference and record-keeping purposes.

All sales are final unless otherwise required by law or stated in our refund policy. For billing issues or refund requests, please see our Refund Policy or contact us at abhirajid@gmail.com for assistance; refund decisions for purchases made through app stores are ultimately handled by Google or Apple.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy. By using the App, you consent to our Privacy Policy.

• We collect personal information as described in our Privacy Policy
• We use Google Analytics and Firebase for analytics
• We transmit your chat messages to OpenAI's API
• We comply with GDPR, CCPA/CPRA, and CalOPPA requirements
• We implement reasonable security measures to protect your data

10. Disclaimers and Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. The philosophical character responses are generated by artificial intelligence and:

• May not always be accurate, appropriate, or reliable
• Should not be considered professional advice (legal, medical, financial, or otherwise)
• Are for educational and entertainment purposes only

We do not guarantee that the App will be uninterrupted, secure, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ₹1,000 (ONE THOUSAND INDIAN RUPEES), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Earth, its owner, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Your breach of any applicable laws or regulations

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

Before filing any legal action, you agree to first contact us at abhirajid@gmail.com to attempt to resolve the dispute informally.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.
